What is a sanction?
When a licence holder has not followed rules and regulations aimed at ensuring gambling is fair, safe and crime-free, we can take action and impose the following sanctions:
- Give the licensee a warning
- Add, remove, or amend a condition to the licence
- Suspend a licence

- Impose a financial penalty

Details of action
Following a review of the operating licence undertaken against Jaydevkumar Parbhubhai Patel (t/a Wyke Gaming & Amusement Centre) (“the Licensee”) the Commission found that the Licensee:
- failed to comply with Social Responsibility Code Provision (“SRCP”) 3.5.6 – Multioperator non-remote SR Code
- failed to comply with paragraph 2 of SRCP 6.1.1 – Complaints and disputes
- breached paragraph 1 of section 172 of the Act.
In line with the Commission’s Licensing, compliance and enforcement policy statement, the Indicative sanctions guidance11 and the Statement of principles for determining financial penalties, the Commission has decided to impose a financial penalty under section 121 of the Act. Given the circumstances of the investigation, Officials considered a financial penalty of £8,429 was an appropriate reflection to the seriousness of the failings. However, in line with paragraph 2.33 of Statement of principles for determining financial penalties the quantum was reduced to £1,429 based on non-affordability.
The Commission has also decided to impose a warning to the Licensee under section 117(1)(a) of the Act.
The Licensee co-operated with the Commission throughout the investigation and took corrective steps to address the identified failings.
